The Board for the Resolution of Procurement Related Disputes Was Created within the State Procurement Agency

The State Procurement Agency makes another move towards equity and full transparency of state procurement procedures.

The State Procurement Agency Board for the resolution of procurement related disputes of became operational on 6 December. The Board is staffed with the representatives of the SPA and non-governmental sector, on the basis of parity principle. The Board is composed of 6 members of whom 3 are the representatives of civil society, being selected by the civil sector itself. The representatives of Georgian Young Lawyers’ Association, Business Association of Georgia and Association of Oil Product Importers and Distributors of Georgia became the members of the Board for one-year term.

Any person, willing to participate in a tender or tenderer is entitled to appeal the acts of a procuring entity with the Dispute Resolution Board before awarding a state procurement contract, provided that the former believes that the Law of Georgia on State Procurement was violated in the course of procuring procedures.

An appeal can be filed with the Dispute Resolution Board electronically, via the official webpage of the SPA: Also, it is possible to proceed with the review of an appeal with the help of modern communications media (e-mail, video-conference). The foregoing will simplify the appeal filing procedure and will make the appeal review procedure ever more transparent

Whenever the Board assures itself of soundness of an appeal, based on of detailed investigation of the appeal and related thereto circumstances, the Board is entitled to demand the revision or revocation of the decision made by procuring entity. The Board is also entitled to solicit before competent authorities, envisaged by Georgia law, for the prosecution of tender participants.
